In response to a series of libellous, highly abusive blogs and criminal acts by Yolanda Soares, Carlos Vicente (By The Music Producoes Musicais/TopEventos) and Chris Bernard Achola

This post is in response to a series of very abusive and slanderous Blogs, perjurious statements and criminal attacks mainly on social networks, started by Portuguese artist Yolanda Soares and partner, Carlos Vicente of By The Music and ongoing since 2010:  http://yolandasoares.blogspot.com/2011/05/este-blog-foi-feito-exclusivamente-para.html  and mainly as an official notice and statement that in accordance with Article 62 of Copyright and Related Rights:

Artist Yolanda Soares and her label/company By The Music ( www.bythemusic.pt ) and TopEventos (both managed by Carlos Vicente) were issued an official Retraction Order (Ordem de Retirada) and are legally banned from using any works authored and/or co-authored by lyricist Alex Fan Moniz, in any shape or form, publicly or privately effective from 3 Jun 2015 (scroll down). Furthermore and after displaying Contempt of the Law, these two individuals and their label have been once again, referred to the Portuguese Public Ministry (DCIAP- Departamento Central de Investigação e Acção Penal & DIAP Cascais, 2.ª Secção Criminal), pending criminal investigation as per below.
This bizarre situation took an even more farcical turn as the Portuguese Authors Society www.spautores.pt) themselves appear either not to know their own legislation, or worse, not to take it seriously. Meanwhile, the serial fraudster duo carries on with absolute impunity:

Most of these allegations are libellous, absolutely false and very bizarre fabrications and tactics of diversion, attempting to damage Mr Fan Moniz' name as author and also at personal and professional levels while trying to draw attention away from their countless legal offences, fraud and indebtedness towards the author. Since June 8th 2013, this series of Internet character assassination attempts has become even more sinister as Yolanda Soares/Carlos Vicente/By The Music appear to have links with a serial cyber-criminal based in South Africa, going by the name of Chris Bernard Achola.

    Since 2010 Yolanda Soares, Carlos Vicente/By The Music have tried to associate Alex Fan Moniz with totally unrelated or made up situations, and persons attempting to discredit, offend and humiliate the author publicly on numerous occasions with blatantly fake articles, rumours and publications. 
    The two even attempted to launch a criminal charge on what they called "false accusations of fraud against Yolanda Soares and her label By The Music relating to a false music award, An'R Award of Excellence" before a Portuguese court, who dismissed the case without trial, due to blatantly false  and perjurious allegations conjured up by these individuals.     The Swiss Authors Society, SUISA have been trying to no avail, since 2010 to collect colossal royalties payments owed to the author by singer Yolanda Soares and her label By The Music. 

    For some inexplicable and obscure reason however (apparently they claim to be "unable to carry out" performance checks on every artist and or event under their management...), the Portuguese Authors Society SPA http://www.spautores.pt have this far, failed to carry out their responsibilities in the matter. 
    Additionally, there are serious irregularities and suspicion of fraud and forgery of documents, personally carried out by artist Yolanda Soares and partner/their company By The Music; again at SPA (Sociedade Portuguesa de Autores) when declaring and registering the album Metamorphosis in early 2010.  
    Yolanda Soares/By The Music face, amongst other offences of civil and criminal nature (see below Wynberg Magistrates Court Order), a very serious charge, along with RTP (Portuguese Television Broadcasting Corporation) of Copyrights Usurpation relating to Portugal's Eurovision Song Contest voting night in 2012. This offence, adding to vast sums of royalties payments not honoured by the singer/her label By The Music since 2010; ultimately lead to the official legal banning by author Alex Fan Moniz of any usage of his works by Yolanda Soares/By The Music, in the album "Metamorphosis" or any other:

    To note that Yolanda Soares (and without questioning the singer's talent)  was virtually unknown even in Portugal until 2010, with only one album out, MusicBox - Fado in Concert, launched in 2007 by Universal Music Portugal. Although innovative (mainly a re-make of famous Fado and popular songs) the CD did not sell, and the relationship between that label and the artist appears to have ended abruptly...

It was however from 2010 with the launch of "Metamorphosis" her second album, of which half the original lyrics were written by Alex Fan Moniz; that the "crossover" singer and her label finally gained recognition in Portugal (and beyond). Songs like Mare Magnificat, Miss Havisham, Olissipo or Keni Indero, all of which created by the British lyricist; besides public recognition and reputation as a brand/artist, gave the singer and her 2 companies unquantifiable financial and personal gains from 2010 to 2016, ongoing.
